Terms of Service

These Terms of Service ("Terms") are an agreement between you and Konnect LLC ("Konnect", "we", "us"). They cover your use of the PeakSets mobile app, the PeakSets MCP server at mcp.peaksets.com, and peaksets.com (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Health and safety: please read

PeakSets is a training log, not a doctor or a coach. Nothing in the Service is medical advice, and it doesn't replace a qualified healthcare or fitness professional.

Talk to a physician before you start any exercise program, especially if you are pregnant, injured, or have a medical condition. Workout plans, whether written by you, an AI, or a pre-built program, may not suit you. Use your own judgment about weights, intensity, and technique. Stop right away if you feel pain, dizziness, or shortness of breath, and get medical help when you need it.

Strength training and race simulations carry an inherent risk of injury. You take part voluntarily and accept those risks.

2. Eligibility and accounts

You must be at least 13 years old (16 in the EU and UK) to use PeakSets. If you're under the age of majority where you live, you need a parent or guardian's permission. You're responsible for keeping your sign-in credentials secure and for everything that happens under your account. Tell us promptly at [email protected] if you suspect unauthorized access.

3. AI integrations

PeakSets lets you connect third-party AI services, such as Muse (Meta), Claude (Anthropic), ChatGPT (OpenAI), or Gemini (Google), through the Model Context Protocol. When you connect one, you authorize it to read and write your PeakSets data on your behalf, including creating and editing plans and saving notes.

Your AI provider is a third party. We don't control it, and its own terms and privacy policy govern your use of it.
AI-generated plans, analysis, and "Coach's Take" insights may be wrong, incomplete, or unsuitable for you. Review them before you act on them.
You're responsible for the actions your connected AI takes in your account. You can revoke access at any time in your AI's connector settings.

4. Your content

You own the workouts, notes, and other content you put into PeakSets ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content only as needed to operate and improve the Service for you. That includes delivering it to AI services you connect and showing it to people you share it with.

When you share a workout, a race card, or a challenge link, anyone with the link can see it. If you join a group challenge, your chosen name and time are visible to other participants. Share only what you're comfortable making visible.

You're responsible for Your Content and confirm that you have the right to submit it.

5. Acceptable use

Don't:

break the law or infringe anyone's rights while using the Service;
access other users' data, or try to get around our security, rate limits, or access controls;
submit false or offensive names or content to shared challenges or leaderboards;
reverse engineer, scrape, or overload the Service, except as applicable law expressly permits;
use the Service to send spam or malware, or to harass others;
resell or sublicense the Service without our written permission.

6. Our intellectual property

The Service, including the app, software, design, exercise library, and PeakSets name and logo, belongs to Konnect and its licensors. We give you a personal, revocable, non-transferable license to use the Service for your own training under these Terms. We keep all rights we don't expressly grant.

If you send us feedback or suggestions, we may use them without any obligation to you.

7. Beta and changes to the Service

PeakSets is currently in beta and distributed by invitation. Features may change, break, or be removed, and the Service may occasionally be unavailable. We may modify, suspend, or discontinue any part of the Service at any time. If we shut PeakSets down, we'll try to give you reasonable notice and a way to export your data.

8. Fees

PeakSets is currently free. Your AI provider may charge for its own service. If we add paid features, we'll tell you the price and terms before you're charged. Purchases made through the App Store or Google Play follow those stores' terms.

9. Third-party services

The Service works with services we don't control, including AI providers, Apple, Google, and app stores. We aren't responsible for them, and your use of them is governed by their terms.

10. Termination

You can stop using PeakSets at any time and ask us to delete your account by emailing [email protected]. We may suspend or end your access if you violate these Terms or if we need to in order to protect the Service or other users. Sections 1, 4 (last paragraph), 6, and 11 through 15 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT YOUR DATA WILL NEVER BE LOST, OR THAT ANY WORKOUT PLAN, CALCULATION (SUCH AS ESTIMATED ONE-REP MAX, PACE BANDS, OR PERSONAL RECORDS), OR AI OUTPUT IS ACCURATE OR SAFE FOR YOU.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KONNECT AND ITS MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR PERSONAL INJURY ARISING FROM EXERCISE YOU PERFORM, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.

Some jurisdictions don't allow certain of these exclusions or limits, so some of them may not apply to you. Nothing in these Terms limits liability that can't be limited by law.

13. Indemnity

You agree to defend and indemnify Konnect against claims, losses, and expenses (including reasonable legal fees) that arise from Your Content, your misuse of the Service, or your violation of these Terms or of anyone else's rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, where Konnect LLC is organized, and by applicable United States federal law, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, and you and we consent to their jurisdiction. If you're a consumer in the EU or UK, you keep the protection of the mandatory laws of your country and may bring claims in your local courts.

15. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest stays in effect. If we don't enforce a provision, that doesn't waive it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, or sale of assets.

We may update these Terms. If we make material changes, we'll post them here with a new effective date and, when appropriate, notify you in the app or by email. If you keep using the Service after changes take effect, you accept the updated Terms.

16. Apple App Store

If you downloaded PeakSets from Apple's App Store or TestFlight, you acknowledge that these Terms are between you and Konnect, not Apple. Apple has no obligation to provide maintenance or support and isn't responsible for the app or for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
